암행어사 공무 활동의 실제와 그 의미- 휴휴자 구강의 일기를 중심으로 -

Abstract

암행어사는 대중적 관심에 비해 그 실제 활동에 대해서는 알려진 바가 거의 없다. 암행어사 일기에는 공무수행 중의 고난과 고생, 낯선 풍속과 풍물, 지역민과의 접촉 등의 여러 가지 사연이 逸話 위주로 흥미롭게 기록되어 있다. 그러나 암행어사의 활동 자체가 엄밀한 보안을 유지해야 했기에, 공적 활동에 대해서는 많은 부분 감춰져 있을 수밖에 없다. 具康의 休休子自註行路編日記 는 암행어사의 공무수행 면모를 파악하기에 풍부한 정보를 담고 있다. 이 자료를 중심으로 암행어사 공무 활동의 실제를 살펴보고, 다른 암행어사 일기도 보조적으로 활용하여 논의를 풍성하게 하였다. 암행어사는 暗行과 明行을 선별적으로 선택해서 활동했다. 아직까지 명행의 존재조차 논의된 적이 없다. 명행은 신분을 드러낸 채 활동하는 것이다. 신분을 드러내는 것이 암행어사의 본질에 위배되지만 방법적으로 선택이 불가피한 경우도 있었다. 명행은 신분을 감추는 것이 무의미한 경우와 신분을 밝힐 수밖에 없는 부득이한 경우에 실시했다. 특히 先文이나 路文을 사용할 수밖에 없을 때 자주 사용되었는데, 구강의 경우에는 제설 작업을 위해 선문을 띄워 도움을 요청하기도 했다. 출도는 추생지에서만 실시했고, 沿路에서 비위를 목도하더라도 즉흥적으로 출도하지 않았다. 이것은 암행어사 상호 간의 중복 출도와 사적인 감정으로 함부로 출도하는 것을 막으려는 의도였다. 암행어사 활동 기간 동안 적게는 3번이고 통상 10번 내외로 출도했다. 암행어사는 각종 공문서의 처리도 맡았다. 암행어사를 불시에 찾아와 억울함을 호소하기도 했지만, 대개는 等狀을 통해 공식적으로 자신의 의견을 밝혔으며, 암행어사는 그에 대해 적절한 뎨김을 내렸다. 구강의 일기에는 이러한 等狀과 뎨김이 상세하게 실려 있어 참고가 된다. 여러 경로로 수집된 정보를 통해 해당 고을의 수령이 저지른 부정을 미리 파악한 후, 출도를 하고 문서를 통한 확인 작업을 한다. 비위 사실이 명확해지면 封庫를 했다. 이렇게 해당 수령이 업무 정지 상태가 되면 옆 고을 수령이 兼官을 맡아 업무 공백을 막고, 뒤에 암행어사가 올리는 書啓를 통해 판단한 뒤 파직 여부를 최종적으로 결정한다. 일반 아전이나 백성들은 죄의 경중에 따라 직접 懲治했다.

When the truth of the scandal became clear, he made an appeal. Ordinary children and the people were directly conscripted according to the severity of their sins.
