우주 안보의 재조명

Abstract

우주 안보 문제는 국제사회가 직면하고 있는 가장 중요한 문제이다. 지상에서의 모든 군사적 및 민간 활동이 인공위성에 크게 의존하는 점을 감안할 때, 우주 자산이 적절히 보호되지 않는다면, 개별 국가뿐만 아니라 국제사회 전체가 심각한 위협에 직면하게 된다. 외기권 조약 등 기존 국제법규범은 오늘날 전개되고 있는 외기권 활동을 규율하는데 부적절하며, 특히 외기권의 군사화 및 무기화는 사실상 국제법의 규울 영역 외에서 활발히 진행되고 있다. 이러한 문제에 대응하기 위해 UN헌장 및 무력충돌법의 외기권 적용 필요성이 제시되고 있지만, 이는 외기권을 평화적 이용의 공간이 아니라, 무력충돌의 공간으로 인식하게 하는 문제를 야기할 수 있다. 우주 안보의 재조명은 무엇보다도 외기권의 평화적 이용 원칙에 입각하여 전개되어야 한다. 이는 매우 중요한 함의를 갖는데, 외기권 활동에 관한 국제법규범 적용에 있어서 외기권의 평화적 이용 원칙이 지도 원칙으로 설정되어야 한다는 것이다. 이를 위해 외기권의 현실이 정확히 파악되어야 하며, 이를 반영하는 새로운 의미의 외기권의 평화적 이용 원칙이 수립되어야 한다. 이러한 맥락에서 우주 안보 문제에 대한 전면적인 재조명이 필요하다. 외기권 관련 기존 국제법규범의 실효성은 있는지, 외기권의 현실에 대한 정확한 인식은 가능한 것인지, 외기권 활동에 대한 우주 강대국을 포함한 다수 국가의 정확한 태도는 무엇인지, 우주 관련 기술의 이중용도 가능성은 어느 정도인지, 우주 안보 확보를 위한 1차적 고려 사항은 무엇인지, 우주군의 역할은 무엇인지 등에 관한 철저한 검토가 필요하다.

Space security is one of the most urgent challenges facing the international community today. As military and civilian activities heavily rely on satellites, any failure to protect space assets could jeopardize not only individual states but also the global stability. Current international legal frameworks, such as the Outer Space Treaty, are insufficient for addressing the complexities of today’s space activities. The rapid militarization and weaponization of outer space are progressing largely outside the scope of existing international law. While some argue that the UN Charter and the law of armed conflict could be extended to outer space, this risks framing outer space as a potential battlefield rather than a domain for peaceful use. A reassessment of space security must prioritize the principle of peaceful use of outer space. This principle should guide the development and application of international law governing outer space activities. Achieving this requires a clear understanding of the current realities in outer space, along with a re-imagined approach to the peaceful use of outer space that mirrors these realities. In this context, a comprehensive reevaluation of space security is essential. This includes assessing the effectiveness of existing international law on outer space, gaining a more accurate understanding of current state of outer space activities, analyzing the positions of major space powers, exploring the potential dual-use threat concerning the ADR, identifying the key priorities for ensuring space security, and clarifying the potential role of space forces.
