- Abstract
- 금융산업의 구조개선에 관한 법률은 금융기관의 인수 및 합병, 부실 금융기관에 대한 감독 및 처리, 금융과 산업의 분리 등 금융 활동의 전 부문에 걸쳐 중요한 역할을 하는 법률이다. 본 논문에서는 이 법률의 내용중 금융기관의 인수 및 합병과 관련한 제4조, 적기시정조치와 관련한 제10조, 그리고 금융과 산업의 분리를 규정한 제24조의 내용을 검토하고 그 문제점을 지적한 후 개정방향을 제안하였다. 제4조의 경우 경쟁제한성의 심사주체인 공정거래위원회의 심사기준이 공정거래법상의 심사기준과 일치하지 않는 불확실성을 제거하되, 국민경제적 필요에 의한 금융감독당국의 재량권 도입을 검토할 필요가 있음을 지적하였고, 제10조의 경우 적기시정조치의 목적에 최소비용의 원칙을 추가하고 규제유예 규정을 삭제할 것을 제안하였다. 마지막으로 제24조의 경우 일부 입법상의 실수를 보정할 것과 최근 금산분리 원칙이 완화됨에 따라 제24조의 적용 배제가 빈발한다는 점을 지적하고 금산분리 원칙의 유지를 제안하였다(JEL: G2, N2)
