- Abstract
- 환지처분 전에 시행자가 체비지를 공사대금에 갈음하여 수급인에게 처분한 경우, 수급인에 대한 파산선고로 인해 도급계약이 적법하게 해지되면 해당 토지는 환취권의 기초가 되는 재산이 된다. 여기서 수급인이 도급계약에 따른 공정률 74.791%인 상태에서 공사를 중단하여 도급인이 도급계약을 해지하였는데, 수급인이 공사대금으로 물납된 체비지를 제3자에게 처분한 경우, 도급인이 대체적 환취권을 행사할 수 있는 범위가 어떻게 되는지가 문제된다. 이와 관련하여 대법원 2023.6.15. 선고 2020다277481 판결은 공사도급계약이 해지된 경우, 수급인은 선급 공사대금에 해당하는 체비지 중 기성고 비율에 상응하는 부분을 제외한 나머지 부분을 반환하여야 한다고 하면서, 환취권의 목적인 재산은 체비지 중 도급계약에 따른 공사 미시공 비율에 한정되며, 따라서 도급인은 위 재산의 환가대금에 해당하는 부분에 한하여 대체적 환취권을 행사할 수 있다고 한다. 이 사건에서 시행자인 도급인은 체비지를 공사대금에 갈음하여 수급인에 매도하고 수급인은 다시 신탁회사에 부동산관리신탁을 하였기 때문에, 대상판결의 타당성 여부를 검토하기 위해, 먼저 체비지와 환지 방식에 의한 도시개발, 체비지에 대한 부동산관리신탁을 차례로 살펴보았고, 체비지가 환취권의 대상인지에 대해 고찰하였다.
