- Abstract
- 학교의 안전사고는 체육수업시간과 과외활동 등 교실 밖에서 많이 발생하고 있다. 이는 체험 및 활동중심의 교육에 대한 수요증대가 안전사고 증가에 많은 영향을 미치기 때문인 것으로 분석되고 있다. 따라서 학교의 안전사고는 스포츠 시설 및 체육활동과 관계가 매우 깊다고 할 수 있다. 본고는 스포츠활동으로 인한 학생사고에 대해 국가의 배상책임에 관한 법리에 대하여 검토한다. 특히 우리의 국가배상법에 많은 영향을 미친 일본의 법제 및 법리를 비교법적 관점에서 살펴보고자 한다. 우선 스포츠와 관련된 학교의 안전사고에 대한 우리나라(한국) 및 일본 양국의 판례의 동향을 검토하여 국가배상책임의 법리적용실태와 양국의 사법부의 태도를 비교하여 보고자 한다.
