Abstract

As industrialization and urbanization is progressing rapidly in modern society, form of environmental infringement into our life is getting more and more various and complicated. Especially, it appears that damage of noise and vibration is very serious. Nevertheless, there is little legal regulations to control such noise and vibration. When environmental infringement of noise and vibration occurs, the only way the victim could deal with the situation is lawsuit. However, at that point of time, the damage is already done. It can be valued positively in that our administration of justice is actively considering the environmental advantages of the plaintiffs, who suffered from noise and vibration. However, a measure should come up to reduce noise and vibration from the beginning stage of administrative planning and the law should allow concerned people to get involved in the administrative decision making process.
