- Abstract
- 빈집을 해결하기 위하여 국가적 차원에서 본격적인 입법의 필요성에 대해 논의하기 시작하였고, 마침내 특별법을 제정하기에 이르렀다. 이와 같은 상황은 한국과 일본 양국 모두 매우 유사하다. 본 연구는 빈집을 해결하기 위한 한국과 일본의 법제를 비교법적 관점에서 검토한다. 양국의 법제는 매우 유사한 대응정책을 갖고 있다. 그러나 빈집을 철거하는 경우에 일본은 ｢행정대집행법｣에 의한 엄격한 절차에 따르도록 하고 있는 반면에, 우리는 ｢소규모주택정비법｣의 규정에 따라 직권으로 진행할 수 있다는 점이 특색이라고 할 수 있다.
