- Abstract
- 본 연구의 대상은 DCFR상 제4권 IV장 E편의 판매점계약편으로 주로 공급자의 의무를 중심으로 고찰하며, 본 연구의 주요내용은 다음과 같다. 첫째, DCFR상 판매점계약의 적용범위와 법적성질을 살펴본다. 둘째, DCFR상 판매점계약편 총칙상 공급자의 사전정보제공의무, 협력의무 및 비밀유지의무를 살펴본다. 셋째, DCFR상 판매점계약편의 공급자의 일반규정상 의무의 내용인 제품공급의무, 이행기간동안 공급자의 정보제공의무, 공급물량 감소에 대한 통지의무, 광고의무와 평판유지의무에 관하여 나누어 고찰한다. 넷째, 이상 공급자의 의무관련 내용의 고찰을 통해 실무자들이 DCFR을 준거법으로 지정하는 경우의 권고사항과 본 논문이 가지는 한계를 적시함과 동시에 향후 연구과제를 논술하고 있다.
