| dc.description.abstract | 국제상거래에서 계약은 사적 자치의 실현수단으로서 그 계약이 유효하게 성립되면 계약당사자에게 이행의무를 부담시키는 법적 구속력의 효과를 갖는다. 계약당사자 중 일방의 계약위반의 결과로 손해가 발생한 경우 이에 대한 법적구제수단이 ‘손해배상’제도이다. 계약위반 또는 채무불이행으로 인한 손해배상의 일반원칙 및 손해배상액의 산정을 통해 채무불이행책임에 대해 당사자를 어떻게 구제할 것인지를 연구하는 것은 계약법 영역에서 매우 중요한 과제이다. 본 연구는 국제물품매매계약상 계약의 위반 또는 채무불이행의 결과로 발생한 손해를 대상으로 손해배상의 일반원칙 및 손해배상액의 산정에 대하여 국제물품매매계약에 관한 국제연합 협약(‘CISG’)과 아시아계약법원칙 초안(‘PACL 초안’)의 규정 및 논의에 대해 비교 검토하고, 이를 통해 논쟁이 되는 규정 및 해석상 차이점을 제시하여 향후 연구자들과 실무가들에게 시사점을 제공하는데 목적이 있다. | - |
