- Abstract
- 본 논문은 CISG상 약관의 편입요건에 관한 학설, CISG 자문위원회의 의견 등을 중심으로 살펴보고, CBEC에서 약관이 실제 사용되는 유형별로 약관이 계약에 편입되었는지 여부에 대한 주요 쟁점과 실무적 시사점을 제시하였다. 하이퍼링크를 통한 약관의 편입과 관련하여 이를 긍정하는 학설이 다수설의 지위를 누리고 있음을 인지하고 그에 대한 대응 필요성이 있다. 대화상자와 이메일을 이용한 약관의 편입여부와 관련하여 이에 대한 참조표시의 요건에 논쟁이 있음을 인지할 필요가 있기에 이에 청약자는 참조표시를 명료히 할 방안을 마련하여야 할 것이 요구된다.
