- Abstract
- 최근 EU는 매도인의 계약적합성의무 및 그 위반에 따른 구제제도 관련 국내법의 상이성을 극복하고 소비자의 보호를 한층 강화하면서 CBEC 거래의 확대 및 디지털요소가 결합된 복합상품에 대한 EU Sales Directive를 제정하였다. 이에 본 연구는 첫째, EU Sales Directive의 적용범위에 관한 내용을 살펴보고, 관련 규정에서 논쟁의 여지가 있는 규정과 해석상의 주요 이슈를 검토해 보고 있다. 둘째, EU Sales Directive상 물품의 적합성 개념을 주관적 적합성과 객관적 적합성의 개념으로 나누어 살펴보고 이들 의무의 구체적인 내용을 검토하고 있다, 셋째, 매도인이 제공하는 물품의 적합성 시기와 어느 경우에 매도인의 물품적합성 의무가 면제되는지를 고찰한다. 이러한 매도인의 물품적합성 의무 관련 내용의 고찰을 통해 무역 현장의 실무가들이 EU Sales Directive를 준거법으로 지정하여 활용 시, 유럽의 소비자를 상대로 한 무역거래에서 유의할 점이 무엇인가를 제시하고 있다.
