- Abstract
- 본 연구는 CISG 자문위원회의 공식의견서의 내용을 중심으로 국제무역거래에서 흔히 발생하는 계약 부적합 물품에 대응하기 위한 구제권인 대체물 인도 및 보수 청구권에 대해서 살펴보았다. 연구의 주요한 내용은 제28조에 따른 대체물 인도 및 보수 청구권 제한 여부, 대체물 인도 및 보수청구의 요건 및 효과, 매도인의 하자보완권과의 관계 등으로 논란이 있는 문제들과 기존의 연구들과 자문위원회의 의견이 차이를 보이는 주제들에 집중하였다. 이렇게 기존의 학설과 CISG 자문위원회의 공식의견을 상호 비교함으로써 대체물 인도 및 보수청구의 원칙을 명확히 하고 실무적인 활용에도 기여 하고자 하였다.
