- Abstract
- EU는 최근 디지털 콘텐츠 및 서비스 거래의 증가와 그에 따른 소비자 피해 등의 문제점을 인지하고 디지털 상품의 계약적합성의무 및 그 위반에 대한 구제제도에 관한 EU Digital Directive를 제정하였다. 이는 궁극적으로 소비자에게는 회원국내 높은 수준의 소비자보호를 달성하고, 상인들에게는 자유로운 CBEC거래에 있어 걸림돌의 하나인 법적 불확실성의 제거를 목표로 한 통일규범에 해당한다. 이에 본 연구는 첫째, EU Digital Directive의 적용범위에 관한 내용을 인적 내지 물적 적용범위로 나누어 살펴보고 있다. 둘째, EU Digital Directive상 제공자의 주요의무로서 주관적 계약 적합성의무와 객관적 계약 적합성 의무의 구체적인 내용을 검토하고 있다. 셋째, 디지털 상품의 계약적합성 시기와 동 의무가 면제되는 경우를 고찰하고 있다. 넷째, 유럽의 디지털 콘텐츠 내지 서비스 시장에 진출하고자 하는 무역 현장의 실무가들이 유의할 시사점이 무엇이 있는지를 제시하고 있다.
