- Abstract
- 계약해제의 효과 중 원상회복의 일환인 과실 및 이익 반환은 계약 체결 전 상태로의 회귀를 목적으로 하여 실무적 중요성이 높다. 하지만 반환의 대상, 범위, 이행시기 및 장소 등 세부 내용에 관하여는 법계 간 규범 차이가 있거나, 명시 규정이 없어 해석 문제가 발생하는 어려움이 있다. 이에 본고는 이들에 관하여 CISG와 최근 개정된 일본 민법을 비교 및 검토하고자 한다. 연구 내용은 첫째, 이자 및 이익 반환에 관한 CISG상 규정 내용의 불확실성 및 학설 간 분쟁을 정리한다. 둘째, 이자 및 이익 반환에 관한 일본 개정 민법상 개정 의견과 함께 학설 및 판례 등을 상세히 분석한다. 셋째, 상기 연구내용에 기초하여 양자 간 상호 비교 후 법리적, 실무적 시사점을 도출한다.
