- Abstract
- 저작권단체가 편의점 등 프랜차이즈 매장에서의 디지털 음원 스트리밍 서비스와 관련하여 공연료를 요구하여 프랜차이즈 업계와 분쟁중이다. 구 저작권법 제29조제2항의 ‘판매용 음반’의 개념이 기술발달에 비해 뒤떨어지고, 엇갈리는 대법원 판결 등으로 인하여 논란이 증폭되고 있다. 이에 따라 ‘판매용 음반’에 대한 분석 및 프랜차이즈의 특성 등을 감안하여 주요 쟁점에 대한 대안을 모색하고자 한다.
