성범죄자의 재범방지를 위해 새로 도입된 제도들의 효과성에 관한 연구

Abstract

성폭력범죄, 특히 아동이나 미성년자를 대상으로 하는 경우 살인 등 강력범죄로이어져 언론의 주목을 받고, 그때마다 재발방지책을 요구하는 여론이 비등해졌다. 이러한 언론과 여론에 부응하여 2010년 전후로 성폭력범죄자를 대상으로 새로운과학기술을 도입한 신상공개제도, 전자감시제도, 성충동 약물치료제도 등 강력한 재범방지책이 도입되었다. 이러한 새로운 재범방지제도들에 대하여 도입 당시의 목적에 적합한 역할을 하고 있는지 평가하고, 그 발전방안을 모색할 시점이 되었다. 각종 성폭행범죄의 발생현황, 재범률, 새로운 제도들에 대한 시행현황을 종합하면, 현재까지의 새로운 제도의 효과성에 대해서는 전자감시는 ‘비교적 효과적’, 성충동 약물치료는 ‘찬반양론 진행 중’, 신상공개는 ‘효과성 의문’으로 요약될 수 있다. 이러한평가를 기초로 전자감시는 그 적용대상을 점차 확대할 필요가 있어 보이고, 신상공개는 그 범위 및 대상을 축소할 필요가 있어 보이며, 성충동 약물치료는 향후 존속여부를 재검토하여야 할 것으로 보인다.

Public opinion became the seething. In response to these media and public, before and after 2010 by introducing the new science technology to prevent sex offender, Registration and Releasing Identies System, Recidivism Control System, Electronic Monitoring System was introduced. These institutions was aiming to appropriate role to prevent sex crimes and now became time to seek the power, and assessing what works. Evaluating based on statistics of the new systems in sex crimes, Electronic monitoring system is ‘very effective’ and Recidivism Control system is ‘pros and cons in progress', Registration and Releasing Identies system is can be summarized as ‘question effectiveness’. Based on this assessment, Electronic monitoring system need to broaden the scope and Registration and Releasing Identies system need to reducing the target and Recidivism Control system is expected to future enlargement should reexamine whether or not.
