한국 공공분쟁의 특징과 해결방안: 정부 관료의 역할을 중심으로

Abstract

민주화 이후 한국 사회는 심각한 수준의 공공분쟁을 경험하고 있다. 지난 10여년간 의 공공분쟁 예방과 해소를 위한 연구와 법제화 노력에도 불구하고 공공분쟁의 양상은 크게 나아진 것 같지 않다는데 문제가 있다. 이제 우리가 던질 질문은, “왜 이러한 일이 반복되고 있는가? 한국 공공분쟁은 정부의 일방적인 결정과 발표에서 시작된다. 정책추진의 절차적 문제와 타당성에 대한 적절한 설명부족은 상호불신과 반목으로 이어지면서 폭력과 적대의 악순환을 일으키게 된다. 이 과정에서 분쟁의 예방에 필요한 노력이 거의 이루어지지 않고 있다. 공공정책에 대한 충분한 합의를 얻지 못한 상태에서 일방적인 정책추진은 반대와 저항을 불러일으킬 수밖에 없다. 관료들의 권위주의적 정책추진은 공공분쟁을 야기시키는 원인으로 작용하고 있는 것이다. 따라서 관료들의 책임성을 강화하는 것이 공공분쟁을 줄일 수 있는 핵심적인 요인임을 강조하고자 한다.

South Korea has experienced serious public disputes since democratization. Few things has changed in spite of legislative efforts and researches for prevention and resolution of public disputes during last decade. This paper investigate why the similar disputes has occurred repeatedly and has followed the same patterns. Public policies in dispute are decided and announced unilaterally, causing a severe confrontations and resistance. Lack of explanation on the necessity of the policies and procedural problems leads to distrust and conflict between the government and critical civilians. It means that the unilateral implementation of the public policies by authoritative bureaucrats is the main factor which causes the public confrontations and conflicts on the public policies. The tightening of political and legal responsibility would be one of solutions for reduction of public disputes.
