중국의 정형무역거래조건에 대한 고찰 -FOB조건과 FCA조건을 중심으로-

Abstract

본 연구는 정형무역거래조건에 관한 것이다. 정형무역거래조건 가운데 FOB조건과 FCA조건에 초점을 맞추어 분석하였다. 일반적으로 FCA조건은 모든 운송수단에 적합하다. 그래서 국제상업회의소는 FOB조건 대신에 FCA조건 사용을 지속적으로 권고하였다. 그러나 한국, 중국 그리고 일본은 FOB조건을 많이 사용해 왔지 FCA조건은 그다지 많이 사용해 오지 않았다. 이렇게 FCA조건이 사용되지 않는 것에 대해 대부분의 선행연구는 FCA조건 자체의 문제점을 지적하였다. 그리고 실증적 검증이 되지 않은 개선방안을 제시하였다. 따라서 본 연구의 목적은 중국에서 FOB조건 및 FCA조건의 사용현황을 분석하고, FOB조건 대신 FCA조건을 사용하는 것이 가능한가에 대해 검증하는 것이다. 연구 대상은 한국의 제1교역국인 중국으로 한정하였다. 또한, 연구 목적을 달성하기 위해 기업의 인터뷰를 병행하였다. 연구 결과 첫째, 기업들은 FCA조건의 필요성을 느끼지 못하고 습관적으로 FOB조건을 사용하고 있었다. 둘째, 운송방식에 부합하지 않는 조건을 선택함으로 인해 문제가 발생할 것이라는 생각은 하지 않았다. 셋째, FCA조건은 FOB조건에 비해 위험과 비용의 요인이 존재하여 FOB조건을 유지한다는 것이다. 결국 습관적으로 사용하고 있는 FOB조건을 보다 다양한 운송방식에 적합하도록 해야 한다. 또한, FCA조건을 사용하는데 위험과 비용의 요인이 없도록 해야 한다. 그래야만 매매당사자가 FCA조건을 보다 많이 사용할 것이다.

This study relates to the trade terms. We analyzed the FOB term and FCA term. In general, FCA term is suitable for all means of transport. So ICC continually recommended the use of FCA term instead of FOB term. South Korea, China and Japan very often used the FOB term, but FCA term was not used much. About these things, most prior studies have pointed out the problems of FCA term itself. and presented the improvement measures that has not been empirical verification. Therefore the purpose of this study is to analyze the usage of FOB and FCA term in China, and to verify the availability of the FCA term instead of FOB term. Study subject was limited to China, which is the first trading partner of South Korea. Also, for achieving the purpose of the study, we interviewed some korea companies. The results of this study is as follows. First, companies did not feel the need the use of FCA term and was using habitually FOB term. Second, by selecting the term that do not suitable the transport means, it was not thought that a problem occurs. Third, Because FCA term exists the risk and cost compared to FOB term, it is that to maintain the FOB term. Eventually, should be so as to suit the various transport means FOB term is customarily used, and should be so that there is no risk and cost of using FCA term. As a result, marketing party use more FCA term.
