한국 선거정치에 있어서 실질적 기회균등을 위한 제도개선 방안: 현직의원과 도전자의 형평성 및 선거공영제를 중심으로

Abstract

포괄적 민주주의의 실현이라는 목표에서 볼 때 한국 선거정치는 새로운 정당이나 소수정당 혹은 새로운 인물이나 정치적으로 열위(劣位)에 있는 후보자들이 공정한 경쟁을 통해서 정치권에 진입할 수 있도록 지원해 주어야 한다. 또한 이를 뒷받침하려는 노력은 공정한 선거를 통해서 실질적인 기회균등을 보장하는 방식으로 진행되어야 한다. 이러한 문제의식에 따라서 이 글은 선거정치의 공정성 제고라는 각도에서 매우 개괄적인 수준에서 문제점을 제기하고 기존의 논의에 필자의 의견을 더하여 개선방안을 제시하였다. 보다 구체적으로 이 글은 선거정치의 기회균등 제고를 위한 제도개선의 영역을 현역의원과 도전자 혹은 정치신인 간 기회균등, 현행 선거공영제와 선거보조금제도의 합리적 운영, 선거보조금 지급 뒤 후보자 사퇴의 문제 등으로 크게 대별하여 제시하고, 이에 따른 대략의 해법을 제시하였다. 현행의 제도는 민주주의라는 이름하에서 운영되고는 있으나, 정치과정의 곳곳에 법령이나 규칙의 비호하에 존재하는 다양한 형태의 이익의 굴절점(bias of interests)들이 점차적으로 제거되거나 완화되어야 공정한 선거정치가 이루어질 수 있다. 이러한 관점에서 현행 선거운동 기간에 대한 규정이나 선거자금과 관련된 선거공영제는 현직의원이나 거대정당에 유리한 방향으로 이익의 굴절을 유도하고 있어서 개선이 요구되고 있다고 할 수 있다.

From the perspective of inclusive democracy, Korean politics needs more to help new and minor parties, and freshmen and disadvantaged candidates. The way for this endeavor should designed in a way to make it sure that a substantive degree of equality of opportunity should be guaranteed through fair electoral competition. With this reform vision in mind, this article diagnoses some problems within the current legal system at the most general level, and proposes some reform areas and their solutions, partly relying upon the ideas suggested by scholars and practitioners. To be more specific, this article discusses the ways for more equal and fair competition between incumbents and challengers, and for more rational management of the current government financing of campaigns. It also addresses remedies for the cases where candidates suddenly exit the campaign without paying back the government campaign subsidy theywere already paid. In conclusion, despite the Korean politics having stepped on the path of democratic deepening, it needs to be more fair in terms of electoral competition and campaign financing. Since the current system largely favors the major parties and their candidates at the cost of the minor parties and their candidates, it needs to be revised for wider political participation.
