청구의 양립과 예비적 병합 - 대법원 2014. 5. 29. 선고 2013다96868 판결을 소재로 -Compatible lawsuits and preliminary consolidation

- Abstract
- 최근 대법원 2014. 5. 29. 선고 2013다96868 판결은 청구의 병합이 선택적 병합인지, 예비적 병합인지 여부는 당사자의 의사가 아닌, 병합청구의 성질을 기준으로 판단하여야 한다고 보았고, 또한 위 판결의원심은, 예비적 병합의 경우에 주위적 청구기각, 예비적 청구인용의 제1심 판결에 대하여 피고만이 항소한때에 항소심에서의 심판대상은 예비적 청구 부분에 한정된다고 보았다.
그리하여 여기서는 위 판결을 소재로 병합 형태의 판단 기준(양립 가능한 여러 개 청구의 예비적 병합의 가부)등에 관하여 필자 나름의 입장에서 분석적 검토를 하였다.
즉, 서로 양립하는 청구라도 예비적 병합으로 할 필요성이나 합리성이 인정되는 경우가 있기 때문에 당사자의의사를 바탕으로 제한적으로 그 필요성과 합리성의 기준에 따라 예비적 병합을 인정하면서, 나아가 주위적 청구기각, 예비적 청구인용의 제1심 판결에 대하여 피고만이 항소한 특수한 경우는 당사자와의 소통이라는 점에서법원은 釋明權을 적절하게 행사하여 원고로부터 부대항소 등을 이끌어 내어 그에 따른 필요한 심리를 다하여야한다는 생각을 피력하였다.
The Supreme Court of the Republic of Korea recently decided (2013DA96868 ruled in 29th,May, 2014), whether a consolidation of lawsuits is preliminary or selective depends on the characteristic of the consolidation of lawsuits, away from the intention of the concerned parties.
The original instance of this ruling said, if only the defendant appeals the first instance's judgment of which the main lawsuit was rejected but the preliminary part was accepted, the court of appeal shall adjudicate only the latter part.
In this regard, I analysis this Supreme Court case in my own perspective including the criteria to qualify the consolidation of lawsuits (whether compatible lawsuits can be applied to court as preliminary consolidation of them).
