유엔군 참전·정전협정 체결 기념의 타당성

Abstract

본 연구는 유엔군 참전 및 정전협정 체결 기념의 타당성을 법적으로 검토하는 것을 목적으로 하고 있다. 이를 위해 6.25전쟁 자체를 기념하던 종전의 인식에서 벗어나 6.25전쟁에 참전한 유엔군과 유엔군 주도로 체결된 정전협정을 분석의 틀로 설정하였다. 그리고 정전협정이 갖는 의미와 분단체제 및 통일과정에서 담당하는 역할을 국제법적 및 국제정치적으로 검토하였다. 본 연구를 통한 분석결과는 다음과 같다. ① 우리나라는 6.25전쟁의 의미만을 강조하였고, 1953년 7월 27일 정전협정이 체결일은 기념하지 않았으나, 이 같은 관행은 현재의 한반도 안보환경에 비추어 재검토를 요구한다. ② 7.27 정전협정 체결일은 유엔군의 지원 하에 한국이 ‘공산군을 격퇴한 날’이자 북한의 공산화 기도를 저지한 ‘자유수호의 날’이며, ‘굳건한 한반도 평화의 토대를 마련한 시발점’이란 역사적·상징적 의미를 갖는다. ③ 정전협정은 지금도 남북한 등 전쟁 당사자들을 법적으로 구속하는 군사조약으로 기능하고 있으며, 향후 평화체제로의 전환․구축을 위한 기초가 될 수 있다. ④ 정전협정 집행책임을 지고 있는 유엔군사령부는 통일과정에서 적지 않은 긍정적 역할도 기대된다. ⑤ 정부는 7.27 기념행사의 내실 있는 개최를 통해 유엔 참전국의 지원, 참전용사들의 수고와 희생을 기리고 감사하는 동시에, 자라나는 우리 젊은 세대들에게 정전협정의 의미와 역할을 올바로 깨닫게 함은 물론, 국가정체성에 대한 확고한 의식을 함양하도록 노력해야 한다. 이러한 결과를 7.27 기념행사의 추진방안에 대해 논의하였다.

This paper investigates Legal Propriety of Commemorating Participation of the United Nations Command in the June 25 Korean War and Conclusion of the Korean Military Armistice Agreement(hereafter abbreviated as KMAA). It stresses it is necessary to reflect on the long-time Korean tradition commemorating outbreak of June 25 Korean War only, considering the present security condition. It analyzes the meaning and role of KMAA in the process of national unification by adopting the international legal and political approach. This research finds that ① in the past, South Korea did not emphasize conclusion of KMAA on June 27, 1953 but outbreak of the June 25 Korean War in 1950, ② on the contrary, the day of July 27 KMAA conclusion is not only the day when South Korea repelled the North Korean People's Army with the support of the United Nations forces, but also the day when it defended freedom and democracy by suppressing the North Korean attempt to communize the whole Korea. Moreover the date is also a starting point of laying the foundation for solid peace on the Korean Peninsula, ③ KMAA is now functioning as a military treaty which has a legally binding force on war participants and is a basis for a new peace regime, ④ positive role of the United Nations Command(UNC) which has a duty of enforcing KMAA is anticipated in the process of national unification of the two Koreas,⑤ the Korean government should praise the UNC's participation in the Korean War and give thanks to war veterans' sacrifice by holding "June 27 day" commemoration event fruitfully. In addition, it could make a good contribution to make younger generation perceive the meaning and role of KMAA correctly and foster a firm sense of country identity as well. Based upon such results, this research concretely discusses how to hold "June 27 day" commemoration event.
