국군포로의 법적 지위와 문제 해결 방안

Abstract

미귀환 국군포로 문제는 전쟁과 분단이 낳은 중대한 인권문제이자 인도적 사안이다. 멀지않은 장래에 생존 국군포로는 거의 다 사라질 공산이 크다. 국군포로는 법적으로 엄연히 대한민국 국민이다. 정부는 이 점을 인식하고 국가적 본분과 도리를 다해야 한다. 보다 더 정확한 진상규명은 물론, 전면적 생사확인, 가족 상봉, 서신왕래, 송환을 단계적으로 추진해야 한다. 더불어 귀환 국군포로의 정착지원 사업을 위탁 방식으로 전환하여 안정적으로 실시해야 한다. 그밖에도 관련 법령을 개정하여 국군포로의 ‘남한에서 재혼한 배우자’에 대한의료 지원, 국군포로 관련 단체를 보훈단체로 인정하고 물질적 지원을 제공하는 등 미진한부분을 보완토록 해야 한다.

The problem of unreturned ROK(South Korea) prisoners of wars(POWs) is aserious issue of human rights and humanitarian affairs as well caused bySouth-North division and the Korean War. Almost all the South KoreanPOWs still alive will disappear because of their old age in the near future. Until now they are nationals of ROK in law. Keeping this in mind, the ROKshould always fulfill ra son d' tre and its full duty as a state. It mustpush on not only with a more exact truth finding but also with full-scaleconfirmation of the POWs' fate, families reunion, exchanges of letters,repatriation etc by a phased approach. Besides those solutions, the SouthKorean government should put into practice a settlement support programfor the returned POWs stably by changing the present service method byannual contract into a new outsourcing method at a long-time basis. Relatedto these matters, it is necessary to revise relevant laws and regulations formedical assistance to a newly-married POW's wife, supply of materialsupport to POWs-related associations etc. Furthermore, the South Koreangovernment should work out plans for the utilization of POWs in terms ofSecurity and Veteran Affairs considering the value of such precious andexceptional assets.
