저작권자의 허락없이 미공표 저작물의 인용시 공정이용에 대한 법적 고찰

Abstract

저작자 등의 정당한 권익보호와 이용자들의 공정한 저작물 이용 보장을 이루기 위해서는 무조건적으로 저작자 등의 권리만을 보호하기보다는 적절하게 저작재산권을 제한하여야 하는데 이에 대하여 우리 저작권법은 저작권법 제35조의3에 따른 포괄적 공정이용규정이 저작권법에 신설전에는 창자작인 저작자를 보호를 중점에 두어 저작물의 이용행위에 대하여 저작재산권제한사유에 해당되는 지에 대하여 저작권법에서 규정하고있는 제한사유를 제외하고는 개별쟁점에 대하여 이익형량을 할 수 있는 재량권이 부여되는 것에 대하여 원칙적으로 부정되는 한정열거주의를 취하였다. 저작권법 제35조의3에 따른 포괄적 공정이용이 신설됨에 따라 기존의 저작재산권제한사유는 한정 열거된 조항이 아니라 공정이용의 일반조항인 저작권법 제35조의3에 따른포괄적 공정이용으로 인하여 예시적 규정에 해당된다고 판단된다. 따라서 기존의 저작재산권제한사유에 해당되지 않더라도 저작권법 제35조의3에 따른 포괄적 공정이용에 해당되는지 판단되어야 한다. 그렇다면 이용자들의 공정이용범위는 어떻게 되는지 여부에 대한 의문이 발생하며,이러한 범위에 과연 미공표 저작물도 포함될 수 있는 지에 대하여 쟁점이 발생한다. 기존의 저작재산권 제한사유에서는 미공표저작물의 공정이용이 쟁점이 될 가능성이 낮았으나, 한․미 FTA이후 우리 저작권법에 신설된 저작권법 제35조의3에 따른 포괄적 공정이용은 공정이용에 대한 일반 조항으로 저작재산권제한사유와 더불어 중첩적으로 적용되는 조항이므로 저작권법 제35조의3에 따른 포괄적 공정이용의 대상에 미공표 저작물의 이용도 해당될 수 있는지가 쟁점이 된다. 이러한 점 등에 대하여 저작권법 제35조의3에 따른 포괄적 공정이용을 통하여 미공표 저작물의 공정이용해당여부를 판단하고 외국입법례와의 비교를 통하여 고찰하고자 한다.

Copyright Act needs to strike balance between interests of copyright holders and free exploitation of copyrighted works by their users. Prior to adopting comprehensive fair use doctrine under Article 35 ter of the Korean Copyright Act, the limitations to copyright protection under Articles 23 to 35had been exhaustive list for free use of copyrighted works. However, those free use limitations guaranteed under the Copyright Act prior to 2011revision turned into illustrative list of fair use due to adoption of comprehensive fair use doctrine pursuant to Article 35 ter of the Korean Copyright Act. In this regard, it should be discussed whether undisclosed copyrighted works are subject to fair use limitation. On the other hand, the Korean Copyright Act recognizes moral rights such as right of disclosure, attribution right, and right to maintain author's integrity. Hence, as far as right of disclosure is concerned, it requires fair use criteria independent from economic rights because Articles 23 to 35 ter are only applicable to the latter. In short, this Article conducts a comparative analysis of fair use of undisclosed copyrighted works. Also, this Article will discuss when undisclosed works can be considered as disclosed ones.
