전략무역자율준수제도에서의 등급제 도입 방안에 관한 연구

Abstract

전세계적으로 테러와 국가안보의 위협이 증가되면서 수출통제체제가 중요해지고 있다. 정부는 전략물자의 수출통제를 위한 법률을 발효시키고 관련된 국제조약 예를 들어 재래식 무기와 특정의 이중사용기술의 축적을 막기 위한 목적의 국제적 조약인 호주그룹, 핵무기공급자 그룹, 재래식무기와 이중 목적물과 기술에 관한 바세르나제협약 등에 가입하는 등 전략물질의 수출통제를 위한 법률을 발효시켜 왔다. 비록 지식경제부 산하의 한국전략물자관리원이 전략물자수출통제를 위해 자율준수제도를 시행해오고 있지만 소수의 기업만 참여하고 있는 실정이다. 그러므로 정부는 수출통제의 자율준수제도에 등급제를 도입하여 높은 등급을 받은 기업에 대하여 보다 많은 인센티브를 제공하여 보다 많은 기업이 자율준수제도를 도입할 수 있는 방안을 고려하고 있다. 본 연구는 자율준수제도에서 등급제를 도입하는 방안과 더 많은 기업들을 그 제도에 유인하기 위해 어떤 종류의 인센티브 방안이 있는지를 분석하는 데 있다.

With growing threats of terror and national security around the world, export control systems have become of significance. Korean government has also taken effect laws and regulations for export controls of strategic materials while joining international arrangements such as the Australisa Group, the Nuclear Suppliers Group(NSG), and the Wassenaar Arrangement on Export Controls for Conventional Arms and Dual-Use Goods and Technologies, which seeks to prevent destabilizing accumulations of conventional arms and specific dual-use technologies and thereby contribute to regional and international security and stability. Although Korea Strategic Trade Institute, a Ministry of Korea Knowledge Economy-affiliated organization, has undertaken compliance program for export controls of strategic materials, a few companies have adopted the system. Therefore it is considered by the government to introduce the grading system in the compliance program of export controls. The system is intended to provide a lot of incentives to the companies which comply to high grades in order to induce more companies to participate the compliance program. This study aims to investigate how to introduce grading system in compliance program and what kinds of incentives for inducing more corporations in the system are possible.
