기술규제의 내재적 특성과 정책과정 현상 분석

Abstract

최근 기술규제에 대한 관심이 집중되고 있으나, 이에 대한 개념정립, 특성 그리고 정책과정에 대한 논의가 미흡한 상황이다. 이에 따라 본 논문에서는 문헌조사와 전문가인터뷰 그리고 법안사례조사를 통하여 기술규제의 개념을 표준과 대비하여 정립하고, 여기에 내재되어 있는 기술규정, 적합성평가에 대해 명확히 개념을 정립하였다. 아울러, 정책과정에서 나타나는 특징을 문제 확인단계에서는 무위험원칙추구현상, 대안형성단계에서는 이종 전문가간 협업의 필요성, 입법화단계에서는 입법보조기관 등의 전문성 부족으로 인한 이해관계자의 적극적 참여필요성, 정책집행단계에서는 준비기관의 필요성, 마지막 정책평가단계에서는 평가의 제한적 실시로 규정하였다. 무엇보다도 급속한 과학기술의 발전에 따라 제·개정 주기가 단축되고 있는 상황이 나타나고 있었다.

Recently, there is a growing interest in technology regulation, but there is insufficient discussion on definition, characteristics, and policy process. Therefore, the goal of this study is to establish the concept of technology regulation through literature review, expert interview, and legal case studies. Moreover, this study defined characteristics that appear in policy process as risk-free pursuit of principles within public agencies in problem verification phase, necessity of collaboration between experts with different background in alternative formation phase, necessity of active participation of interested parties due to lack of expertise of law-making subsidiary institutes in legalization phase, necessity of preparation agency in policy implementation phase, and limited assessment in policy evaluation phase. Above all, the situation of enactment·revision period getting shortened by the rapid development of science and technology was emerging.
