권리사용료의 관세평가에 대한 사례 연구

Abstract

권리사용료에 대한 관세평가로 인하여 수입국의 세관당국과 수입자간의 다양한 형태의 분쟁이 발생하고 있다. 이러한 분쟁으로 인하여 관세평가가 새로운 관세장벽으로 대두되고 있다. 본 연구에서는 이러한 권리사용료 관련 분쟁에 대해서 분석하기 위해 국내외의 권리사용료 관련 분쟁 사례를 분석하였다. 관세평가 분쟁을 예방하고 관리하기 위해서는 관세평가 관련 법령의 재정비와 법 개정이 필요하다는 결론을 도출하였다. 그리고 수출입 기업들이 분쟁을 예방하고 회피하기 위해서는 관세통관 전문가인 관세사를 적극적으로 활용할 필요가 있다고 판단된다. 관세평가 분쟁과 관련한 전문 인력을 확충하고 보강하기 위해서 관세사의 증원과 역량강화가 필요하며, 대학교 수준에서 무역과 관세통관에 대한 교육의 강화가 필요하다판단된다.

Purpose : As technology advances, various intellectual property rights are used to make products. In customs valuation, the fees for the use of intellectual property rights related to imported goods and paid on the terms of the transaction shall be added to the Transactional Value of imported goods. Thus, there are frequent disputes over whether the fees for the right to use intellectual property should be included in the Transactional Value of imported goods. The time and cost of resolving these disputes are creating a new tariff barrier. Research design, data, methodology : This study analyzed the case of Customs Valuation conflicts with domestic and foreign royalties and Licence fees. Results : Reforming and revising laws related to Customs Valuation are necessary to prevent and manage Customs Valuation disputes. Conclusions : It is deemed necessary for import and export companies to actively utilize certificated customs agents who specialize in customs clearance to prevent and avoid Customs Valuation disputes. In order to expand and reinforce expert personnel involved in the Customs Valuation dispute, more certificated customs agents and stronger capabilities are needed, and education on trade and customs clearance is needed at university level.
