자(子)의 인도청구의 집행방법에 관한 연구

Abstract

친권자에 의한 子의 인도청구의 강제집행을 어떠한 방법에 의하여 행할 것인가에 대하여 현행 민사집행법상 명문 규정이 없다. 따라서 본 연구는 子의 인도청구를 어떠한 강제집행의 방법에 의할 것인가를 검토한 것이다. 우선 子의 인도에 관한 집행방법에 관한 현재의 상황을 개관하여 문제점을 파악하고, 나아가 최근 상당한 논의가 진행 중에 있는 일본의 입법적 작업을 소개하고, 마지막으로 최근 국회에 제출된 가사소송법 개정법률안 등을 분석하였다. 이를 전제로 子의 인도집행의 특성에 비추어 子의 이익이나 복지에 충분한 배려를 하여야 한다는 관점에서 그 규율의 정비에 관하여 살펴보았다.

The Civil Execution Act in force contains no provision on how to enforce a request for child handover made by a person with parental authority. Against this backdrop, this study examines possible enforcement methods regarding a request for child handover. This study firstly provides a brief look at the current situation concerning how to enforce child handover in order to identify any outstanding issues. Then, it introduces the ongoing legislative process in Japan which has been subject to intense debate recently. Lastly, it analyzes the bill on amendment of the Family Litigation Act recently submitted before the National Assembly of Korea. Based on this, the study shed lights on possible overhaul of applicable law, given that children’s interests and welfare deserve sufficient consideration in light of the unique features of child handover enforcement.
