거버넌스 도구로서의 규제

Abstract

신공공관리가 전통적 행정학과 다른 점은 정부의 행위에 있어서 도구나 기술적인 측면에 초점을 두고 있다는 점이다. 규제는 공공관리에 있어서 가장 중요한 도구의 하나이다. 이러한 규제는 한 동안 철폐되거나 완화되는 것만이 유일한 개혁대안으로 제시되어 왔다. 그러나 이제 더 이상 규제완화가 강조되지 않고, 규제가 시장실패를 통제하는 적합한 정부행위라고 인정되고 있다. 다만 정부는 필요하고, 정당하며, 효과적이고, 활용가능한 규제를 준비하여야 하는 의무가 있다. 그리고 또한 규제는 광범위한 지지를 받을 수 있어야 하기도 한다. 좋은 규제가 되기 위해서는 규제에 대한 특정 기준들이 잘 지켜져야 한다. 이 연구는 14개의 규제기준들을 제시하고 있다. 그리고 이 기준에 맞춰 한국 정부의 규제실태를 평가해 보았다. 그리고 대부분의 한국 규제행위는 좋은 규제의 기준에 맞지 않다는 것을 밝혔다.

The focus on the tools or technologies of public action differentiates the new governance from classical public administration. Regulation is one of the most important tools of governance. Once Deregulation is the only way to reform the regulatory policies. Nowadays, regulation is recognized as appropriate public action to control market failure. However, the government should ensure that regulations are necessary, fair, effective, affordable and enjoy a broad degree of public confidence. To achieve this, regulation should meet certain principles of good regulation. This research paper suggests fourteen principles of good regulation and evaluate regulatory polices of Korea based on these principles. It is found that Korean government's regulatory practices have not followed the good regulation principles.
