시민 정치참여의 제도화: 독일의 e-청원 사례를 중심으로

Abstract

본 연구는 독일 연방의회의 e-청원제도가 대의제 민주주의의 위기에 대한 제도적 보완이 될 수 있음을 제시하고, 독일 의회가 e-청원제도라는 개혁을 받아들이게 된 요인에 대해 분석한다. 특히, 숙의 민주주의의 현실적 적용이라는 점에서 독일 e- 청원제도는 시민의 적극적 정치참여를 돕는 제도로서 의미가 있다. 독일 연방의회는 e-청원제도가 의회의 입법기능을 약화시킨다는 우려를 드러내기도 하였다. 그러나 의회 내 청원위원회라는 제도적 장치를 통해 e-청원제도는 의회의 입법기능을 대체하기보다 보완하는 역할을 하는 것으로 나타났다. 동시에 연방의회는 지속적으로 하락하는 의회에 대한 국민의 신뢰도를 보완하는 방식으로 e-청원제도를 채택하였다. 본 연구는 직접 민주주의적 특성을 지닌 숙의 민주주의의 성공은 대의 민주주의 제도와의 긴장이 아닌 제도 내 조화가 중요하며 특히 시민참여의 제도적 장치가 정착되는 것이 중요함을 확인하였다. 따라서 독일 연방의회의 e-청원제도는 향후 한국의 숙의 민주주의 활성화에 기여하는 요인을 분석하는 모델로서 의미가 있다.

This research aim to explore that German e-Petition plays an significant role on institutional supplementation for representative democracy. Also, the research analyzes the factors that led to the adoption of institutional reform by German Bundestag. German e-Petition system is relevant in that it is a practical application of deliberative democracy. Although there was concern that German e-Petition system weakened the Bundestag’s legislative functions, Bundestag considered that e-Petition system did not undermine the principle of representative democracy, by passing through the parliamentary petition committee. Simultaneously, Bundestag adopted the e-Petition system for improving parliament’s approval rate. German Bundestag’s e-Petitions system will provide a model for the promotion of deliberative democracy in Korea.
