좋은규제: 통제수단에서 정책도구로

Abstract

규제란 정부의 가장 중요한 서비스임에도 불구하고, 전통적 규제는 일방적인 명령과 통제의 방법만 사용하여 국가의 생산성에 저해를 주기도 하였다. 하지만 과도한 규제완화의 폐해는 미국, 영국, 칠레 등으로 하여금 금융위기를 겪게 하였다. 이에 따라 80년대 후반부터 재규제와 더불어 좋은 규제를 만들어나가는 규제발전이 이루어지고 있다. 좋은 규제를 통해서 규제대상자들은 규제과정에 적극적으로 참여하고, 정부와 끊임없이 협상하고, 규제에 대한 대응방법을 선택할 수 있게 된다. 규제의 방법론도 직접적인 규제에서부터 자율규제에 이르기까지 규제강도와 참여의 정도가 다양하게 적용될 수 있도록 발전하고 있다. 또한 규제에 있어서도 규제대상자들의 비용이 최소화되기 위한 규제전달체계의 발전도 이루어지고 있다. 따라서 규제는 정부의 강제성과 직접성을 최소화시키고, 투명성과 자동성이 최대화될 수 있는 방향으로 발전하고 있다.

Regulation is the most important policy tool of the government. However, traditional regulation was impeding the economy by inefficient command and control methods. Therefore, the first stage of regulatory reform was "deregulation." But the efforts of deregulation was only partially successful, and even brought about financial crisis in U.S.A., England, and Chile in late 1980s and early 1990s. Deregulation gave way in the 1980s and 1990s to regulatory and management reform; better regulation. Better regulation encourages stakeholders' participation and collaboration in regulatory process. It also allows the regulatee to develop their own ways of meeting regulatory requirements. The studies on better regulation have developed series of alternatives to state-imposed regulation. Regulatory service delivery system is focused by better regulation research group recently. These regulatory reform efforts will encourage transparency, automaticity, and flexibility of regulatory process.
