- Abstract
- 公任務의 民間化(私的化, 私事化, 民營化, Privatisierung)는 공법의 지배적 주제이다. 형식과 국면이 다채롭다. 그것들은 행정법과 행정법의 整序力을 시험한다. 이 때 명백한 사실은, 용어상의 다툼문제에서 종종 그 원인이 불명료한 기본개념이나 상이한 사전이해에 있다는 점이다. 민간화논의의 轉機的 기본개념의 하나가 “公任務”이고, 國家任務 개념에 대한 그것의 불분명한 관계이다. 시스템의 기본과 관련이 있는 행정의 모든 개조에서처럼, (민간화논의에서도) 헌법상으로도 질문이 던져 진다: 국가가 공임무를 민간의 힘 또는 自家規制의 조종수단으로써 수행할 때, 무엇을 국가가 民間化할 수 있으며, 무엇이 국가에게 유보되어 있으며, 어떠한 법체제의 지배를 받으며, 어떠한 法形式에 구속이 되는가?
