평생교육법 개정의 쟁점과 과제 - 시행과정에서 나타난 문제점 분석을 중심으로 -

Abstract

이 논문은 최근 논의되고 있는 평생교육법 개정 움직임에 앞서 2000년 이후 5년간의 평생교육법 시행과 구축 과정에서 노정된 문제를 되짚어 보고, 이를 바탕으로 평생교육법 개정은 평생교육법을 통하여 건설하고자 하는 평생교육 체제의 밑그림이 무엇인지 살펴보는 ‘근원적 접근’에서 시작해야한다는 문제 제기에서 출발한다. 이러한 근원적 접근에서 평생교육법 시행 과정에서 나타난 구조적 문제점을 분석하고, 이를 평생교육법 개정을 위한 과제로 제시하였다. 분석 결과, 현재 평생교육법 시행 과정에서 나타나는 문제는 평생교육법의 불안정한 지위에서 출발하기 때문에 평생교육법은 모든 평생교육 관련법을 조정 통괄하는 「평생교육기본법」으로 개정하는 전면적 개정이 필요한 것으로 나타났다. 여기에는 법의 목적, 평생교육의 이념, 국가 및 지방자치단체의 임무, 지원체제, 평생교육센터, 지역평생교육정보센터, 평생학습관, 평생교육협의회 운영, 평생교육사, 평생교육사, 평생교육시설 등이 모두 개정 대상으로 포함되는 것이 필요하다고 보았다. 끝으로 법의 목적을 고려하지 않았고 사회교육정책조정위원회 설치와 사회교육 영역을 상실한 사회교육법의 평생교육법의 개정은 손실이 더 큰 개정이었음을 상기키시고, 내실 있는 개정이 필요하며, 평생교육 개정에는 정책 당국자와 정치가의 역할이 중요함을 제시하였다.

Amendment of the Lifelong Education Law should be started with examining a lifelong education system Lifelong Education Law tries to build. In addition, it is necessary to analyse the problems revealed in the enforcement of Lifelong Education Law for the last five years. In this regard, the paper is an attempt to analyze both structural and operational problems of enforcement of the Lifelong Education Law and to suggest the issues and tasks revolving around reforming the Law. As a result of analysing, the paper has presented several suggestions for more drastic amendment. 1) Lifelong Education Law should be changed to the form of Basic Law of Lifelong Education which can control and synthesize all related laws of lifelong education. 2) The aim and ideals of lifelong education should be reconsidered. 3) The scope of the amendment should include duties of nation and local government, support systems such as the National Center for lifelong education, the local information centers for lifelong education, the lifelong education halls, the local committees of lifelong education, lifelong educators, lifelong education facilities and so on. Finally, it is suggested that to become more substantial, the amendment should carefully consider an aim of the Law and a realm of lifelong education. And also policy makers and politicians should play an important role for more substantial revision.
