디자인경영 측면에서의 디자인권 변화에 관한연구 - 디자인권 분쟁을 중심으로 -

Abstract

산업시대에서 디지털 시대로의 전환에 따라 기업경영은 디자인경영으로 변화하고 있다. 이에따라 디자인은 중요한 요소로 부각되고 있다. 또한 전세계적인 지식기반사회 진입에 따라 기업이 중시하는 가치와 비중은 전통적인 유형자산에서 원천기술, 디자인 등의 무형자산으로 변모하고 있다. 특히 미국과 일본 유럽연합은 최근 특허 전략을 강화하며 기술 보호에 나서고 있다. 이러한 상황에서 원천기술과 디자인은 기업의 경영에 있어서 중요한 요소로 자리잡고 있다. 또한 기업의 분쟁이 원천기술 뿐만 아니라 디자인으로 까지 번져가고 있다. 본 연구에서는 디자인경영과 디자인권에 대해 고찰하고 국내외 지식재산 분야의 동향과 디자인 특허 분쟁 동향을 통해 디자이너들의 디자인권에 대한 인식재고와 기업의 경영전략 측면에서 디자인이 미치는 영향에 대해 알아보는 것에 그 의의가 있다.

As we shift more and more toward digital society from industrial based age, design management needs to keep up with change in business management since design is emerging as a critical factor. As paradigm is changing to knowledge-based society globally, companies’ valued and weighted asset is moving from traditional tangible asset to intangible assets such as design and original patented technology. Recently, U.S., Japan and EU countries are consolidating patent strategy which leads to protection of its corporate design and technology. Ownership of original or patented technology and design has become key factors in corporate management and its growth. We have witnessed numerous cases of design patent conflicts among global corporations recently. This thesis aimed to study design management and design rights and based on recent trends in design patent conflict and domestic and overseas knowledge asset management, it studied designer’s awareness of design rights and how design impacts corporate management strategy.
