Abstract
This article tracked Kang You-wei’s Master plan for Reform from the Sixth Memorial to the Throne in early 1898 to The Coup of 1898. To this end, I divided the phases into short-term plans within one year, a mid-term plans for three years, and a long-term plans for ten years, and each of these step-by-step plans was examined in various ways how they relate to the enactment of the Constitution and the establishment of parliament. After Sixth Memorial to the Throne in early 1898, Kang You-wei though that in order to practice Reform Master plan from above without any hitches, it was necessary to set up a 10-year long-term plans, should be arranged the order of priority of one after another, priority of gravity, and control urgency. Therefore, Kang set standards based on the importance and urgency of Reform, and presented a 10-year short and long-term timetable for the Enactment of the Constitution and the Establishment of parliamentary system with each of these step-by-step plans. The action plan was to consider the establishment of an institutional bureau(制度局) with the characteristics of the Senate as a transitional organization for the establishment of the parliament, through the legislative and discussive functions of the institutional bureau, and to specifically stipulate matters related to the parliamentary system, elections, and the timing of establishment within the constitution enacted by the institutional bureau. Through this, the constitution presented by Kang was a Japanese-style constitutional law, and the parliament system was a bicameral parliamentary system, including members of the popular vote. Based on the above-mentioned research, if I present a Kang you-wei’s blueprint for establishment of parliamentary system in 10 years, it can be summarized as following four things. 1) The adoption of an Integrated style separation of powers based on the theory of organisms, 2) The adoption of the Prussian-style bicameral parliamentary system, 3) The Emperor’s convocation of the parliament, 4) Granting legislative and voting rights to the bicameral parliament.
