생활물류서비스발전법의 주요 내용과 과제에 관한 연구

Abstract

생활물류의 역할은 여러 가지 차원에서 살펴볼 수 있는데 첫째, 라스트마일 딜리버리의 역할을 수행한다. 라스트마일 딜리버리는 물류업체가 상품을 소비자에게 직접 전달하기 위한 배송 마지막구간을 의미하는데 수익성에 한계를 느낀 물류기업들이 새로운돌파구로서 관심을 돌리고 있는 분야이다. 둘째, 도시물류의 문제점의 해결사로서의 역할을 수행할 것이다. 셋째, 공동주방형 일반음식점 도입 등 공유경제를 가속화시키는 역할을 수행할 것이다. 2021년 1월 26일 생활물류서비스산업발전법이 제정되었고, 시행규칙과 시행령이 마련되어 7월 27일부로 시행되고 있다. 동법에서는 택배 등을 생활물류서비스사업으로 정의하고 있으며 이러한 사업과 산업을 체계적으로 육성하기 위한 각종지원제도를 마련하고 있을 뿐만 아니라 생활물류서비스종사자의 보호를 주요 내용으로 규정하고 있다. 동법은 제20대 국회에서도 제정 시도가 있었으나 제21대 국회에서 관련 법률안은 화물업계 등 이해관계당사자, 전문가그룹과의 논의가 있었고, 법안심사과정에서 수정ㆍ보완의견이 반영되어 입법화되었다. 본 논문은 생활물류서비스산업발전법의 주요내용을 살펴보고 그 과제를 탐색함으로써 생활물류서비스산업발전법이 제대로 정착되어 생활물류가 활성화되고 생활물류 스타트업의 창출에 기여하고자 하였다. 연구결과 생활물류의 정확한 정의와 함께 관련산업 종사자와 그 범위, 시설, 운송수단 등의 규정이 미흡하여 이의 보완이 필요하다.

The role of consumer logistics can be viewed from several dimensions. First, it plays the role of last mile delivery. Last mile delivery refers to the last section of delivery for logistics companies to deliver products directly to consumers. Second, it will play a role as a solver of urban logistics problems. Third, it will play a role in accelerating the sharing economy, such as introducing a common kitchen type restaurant. On January 26, 2021, the Consumer Logistics Service Industry Development Act was enacted, and the enforcement rules and ordinances were prepared and implemented as of July 27. The Act defines parcel delivery services as a daily logistics service business, and provides various support systems to systematically foster these businesses and industries, as well as stipulates protection of daily logistics service workers as the main content. Attempts were made to enact the same law in the 20th National Assembly, but in the 21st National Assembly, the related bills were discussed with stakeholders such as the cargo industry and expert groups, and amendments and supplementary opinions were reflected in the legislative process. By examining the main contents of the Consumer Logistics Service Industry Development Act and exploring its tasks, this thesis aims to contribute to the establishment of the Consumer Logistics Service Industry Development Act to revitalize the consumer logistics and to create a consumer logistics start-up. As a result of the study, the precise definition of consumer logistics, along with the regulations on related industry workers and their scope, facilities, and means of transportation are insufficient, so it needs to be supplemented.
