한국과 미국 예산결정과정 비교 분석

Abstract

예산이 결정되는 과정은 의회와 정부를 비롯한 참여자들 간의 역학관계를 반영한다. 본 연구는 예산법률주의를 택하고 있는 미국과 예산 비법률주의를 택하고 있는 한국의 예산 결정 과정을 비교 분석한다. 한국의 경우 예산안 편성권은 정부에, 심의･의결권은 국회에 부여하고 있다. 2012년 국회선진화법 이전에는 대부분 극한 대치 속에서 예산안이 강행 처리되었으며, 2012년 이후에는 모든 예산안이 외면적으로는 합의 통과되었지만 예산안자동부의제 때문에 야당이 끌려갈 수밖에 없는 구조적 한계가 드러났다. 미국은 의회가 대통령의 예산서에 구속됨이 없이 예산을 편성하고 심의할 수 있는 권한을 가지고 있는 것을 의미하는 ‘예산법률주의’를 택하고 있다. 미국도 양당의 양극화와 대립상태가 예산 과정에서 위기를 불러왔다. 이러한 문제를 해결하기 위하여 미국은 수퍼위원회(Super Committee), 강제몰수(Sequestration) 등 특수한 제도를 도입했다. 특히, 미국은 초당파 정치(bipartisanship)를 내세우고 있는데, 이는 2013년 자동예산삭감의 발동으로 타격을 입게 된 국방 예산에 대하여 양당이 초당적 예산법(Bipartisan Budget Act)을 통해 해결한 사례에서 나타난다. 미국은 예산법률주의에 의거하여 법으로 명확하게 초당파적 합의를 반영할 수 있기 때문에, 불확실성을 제거하고 정치적 상황 변경으로 인한 혼란을 방지할 수 있다. 미국의 예산 결정 과정이 개개의 정치적 판단들이 모두 존중되는 가운데 제도에 따른 충분한 숙의에 의한 ‘합의’ 라는 성숙된 민주주의 가치가 반영된 결과라면, 한국의 경우는 제도적 미비점과 짧은 심사기간으로 인하여 정치적으로 극화(polarization)되고 예산 결정 과정에서 참여자임에도 불구하고 주변화(marginalization)되면서 발생하는 갈등 양상이 심각하다. 따라서 본 연구는 한국 예산 결정 과정 개선을 위해 다음과 같은 제도적 방안을 제시한다. 첫째, 예산법률주의의 도입이다. 둘째, 정부 증액동의권의 폐지이다. 셋째, 실질적 권한을 가지고 있는 초당적 위원회의 설치다. 넷째, 예산심의 과정을 대폭 수정하는 국가재정법의 개정과 예결위의 상임위화다.

The process of making a national budget reflects the power dynamics between parliament and government and other participants. This study analyzes the budget decision process of South Korea, which adopts budget non–legalism and the budget legalism of the United States. In South Korea, the right to organize the national budget is given to the government and the right to review and vote for it is given to the National Assembly. Before 2012, the budget proposal was enforced in the most extreme confrontation. After 2012, all budget proposals have been passed, but severe structural limitations have been found in that the opposition party could not take an initiative because of the automatic budget provision. The US budget legalism means that Congress has the power to organize and review the national budgets without being bound by the president's budget request. In the United States, the partisan polarization and confrontation has at times created a crisis in the budget process. In order to solve this problem, the United States introduced special institutions such as the Super Committee and Sequestration. In the US budget making process, the bipartisanship is supposed to be formed. This could be found in the case of the Bipartisan Budget Act that resolved the issue of defense budget under the sequestrations in 2013. Because in the United States, the bipartisanship consensus can be formed by law under the budgetary legalism, it can eliminate uncertainty in forecasting and prevent confusion caused by political changes in the future. The US budget making process reflects the value of a matured democracy of ‘consensus’ with sufficient deliberation and the respect for all the individual political judgments. However, in the South Korean case, due to institutional flaws and short review periods, there often arise extreme conflicts because of political polarization and the marginalization of many stakeholders. Therefore, in order to improve the Korean budget process, this study suggests the following institutional measures to be adopted: the introduction of budgetary legalism, the abolishment of Government's Consent to Increase the Budget, the establishment of a bipartisan committee with substantial authority and the amendment of the National Finance Law to drastically revise the budget review process and install the Executive Committee.
