공익법인으로서의 재단 육성 및 규제정책

Abstract

한국의 재단들은 정부에 의해 강력한 규제의 대상이 되어왔다. 재단은 대부분 세금을 회피하기 위한 수단으로 활용되는 것으로 오인되어 왔으며, 기껏해야 저급한 자선기관 정도로 인식되어 왔다. 그러나 외국에서는 최근 국가의 역할에 대한 새로운 평가와 더불어 민간부문의 역할을 재평가하게 되었으며, 재단의 사회적 기여도에 대해서도 재인식하게 되었다. 재단에 대해 부정적이었던 보수적인 유럽국가들에 있어서조차 재단의 활성화를 위한 새로운 입법이 시도되고 있기도 하다. 한국 정부도 이제 재단에 대한 인식을 새롭게 하고, 기존의 규제자적인 역할을 유지하면서, 동시에 재단의 활성화를 위한 지원자의 역할도 담당하여야 한다.

Activities of foundations, in Korea, have been strongly regulated by the government. Foundations are treated as third-class charities at best. Mostly, donors of foundations are accused that they use foundations only to control their money which would otherwise go in taxes. However, as part of a general reappraisal of the role of the state in modem society, philanthropic foundations were rediscovered by policymakers and donors alike, and it now seems as if foundations are experiencing an new era of renaissance in foreign countries. Even some conservative European countries have begun to enact legislation aimed at encouraging the establishment of foundations. Korean government has to change its attitude against foundations. While it keeps its supervisory role, Korean government has to take a role of sponsor at the same time.
