지방자치단체 수행사무 구분체계의 개편방향

Abstract

본 연구는 첫째, 국가위임사무와 지방자치사무를 구분함에 있어서 지침이 될 수 있는 원칙과 기준을 도출하고, 서울시가 수행하고 있는 사무에 도출된 기준을 적용하여 실제 재분류함으로써 향후 중앙정부와 서울시간의 사무배분을 둘러싼 논쟁에 객관적인 자료들을 제시하는 것이고, 둘째, 사무구분체계와 관련된 독일과 일본의 사례를 검토함으로써 지방자치단체의 수행사무 구분체계의 개선방안을 모색하는 것을 주된 목적으로 하고 있다. 이를 위해 본 연구는 2001년도 국회 3개 상임위원회(행정자치위원회, 건설교통위원회, 환경노동위원회)의 서울특별시에 대한 국정감사 요구/질의자료를 대상으로 국가사무와 자치사무의 구분을 시도하였다. 본 연구는 지방자치단체가 수행하고 있는 사무의 구분을 일차적으로 법령상의 표현에 의하여 구분할 것을 제안하고 있으며, 지방자체단체 수행사무 구분체계의 궁극적인 개선 방향으로 기관위임사무의 폐지와 일본과 같은 법정수탁사무의 도입과 사무의 구체적 성격과 실질적 수행주체에 따른 공동사무의 자치사무와 국가사무로의 재구분을 통한 사무구분체계의 간결화를 제시하고 있다.

The first purpose of this study is to develop the principles and criteria which can be employed to distinguish the local government's own functions from the delegated functions from the central government, and then reclassify the local government functions actually implemented in Seoul Metropolitan Government by utilizing the principles and criteria developed in this study. This analysis is expected to contribute to clarify the debates on the distribution of functions between central government and local governments. The second purpose of the study is to grope the alternatives to the current classification system of local governments through reviewing the German and Japanese cases. For these analyses, this study used the national assembly's inspection list requested to the Seoul Metropolitan Government by the Administration and Local Autonomy Committee, the Construction and Transportation Committee, and the Environment and Labor Committee of the National Assembly. This study suggests that the classification of local government functions should be dependent primarily upon the expression in the statutes. As the directions for more fundamental change this study proposes the abolition of the delegated functions by the central government and the establishment of the trusted functions like in Japan. In addition this study suggest the simplification of the classification system through reclassifying the shared responsibility into local government's own function and central government function according to the substantial property of functions and the virtual location of responsibilities.
