- 경찰, 법원, 교정 등 형사사법 분야의 민영화가 가속화되면서 형사사법 민영화에 대한 논란 역시 커져가고 있다. 복지, 교통 등 다른 부문의 민영화와 형사사법의 민영화는 크게 다르기 때문이다. 근대 국가가 강제력의 독점에서 출발한다는 점을 감안할 때 형사사법의 민영화는 궁극적으로 국가의 역할과 본질의 차원에까지 연결되며, 어떤 정치 이념을 갖고 있느냐에 따라 형사사법의 민영화에 대한 시각과 판단이 달라지는 것이다. 형사사법 민영화의 정도는 정치이념에 따라 결정되는 것이다. 이와 같이 형사사법의 민영화는 정치이념과 불가분의 관계를 가지고 있음에도, 국내는 물론 외국에서도 형사사법의 민영화를 정치 이념적 관점에서 분석하는 경우가 매우 드물다.
형사사법의 민영화를 정치 이념적 관점에서 살펴보면 형사사법의 민영화는 다른 부문의 민영화와는 상당히 다르게 다분히 당의(糖衣)적이고 포장적인 성격을 띠고 있음을 알 수 있다. 경비업체, 민간조사, 민간교도소 등 형사사법 민영화의 근거로 제시되는 대부분의 사례들이 사실상 ‘유사 민영화’나 ‘부분 민영화’의 결과만을 보여주고 있다. 강제력 독점의 포기와 강제력의 시장 이양은 곧 국가 존폐의 문제로 연결되기 때문에 국가는 결코 강제력의 독점을 포기하거나 시장에 완전히 넘겨줄 수 없는 것이다.
수백 년 이상 지속되어온 사설 경호 등 보안업체의 활동은 국가 강제력의 핵심적 부분까지 넘겨받은 것이 아니다. 형사사법의 '완전한' 민영화가 이뤄진다면, 민영 보안업체가 경찰이나 법원 등 다른 국가 형사사법기관의 조직과 역할을 완전히 대체하거나 혹은 대등한 입장에서 역할과 기능을 담당해야 하는 것이다. 형사사법의 민영화를 정치 이념적 관점에서 심층적으로 검토하고 분석하지 않았기 때문에 형사사법의 민영화가 당연히 이뤄져 온 것과 같은 착시현상이 발생했던 것이며, 이런 측면에서도 형사사법 민영화의 개념을 철저히 파악 하기 위해서는 정치 이념적 고찰이 반드시 필요하다고 하겠다.
The rapid growth of private security has been stirring up controversy over the privatization of criminal justice. For privatization of criminal justice is much different from that of social welfare and transportation. Privatization of criminal justice must be related to the essence and role of the state, based on the fact that a modern state presupposes the monopoly of coercion. The extent of privatization of criminal justice, thus, depends upon political ideology. There have been, however, few researches on the privatization of criminal justice from the perspective of political ideology.
Privatization of criminal justice appears to be sugar-coated, being different from that of other areas. Private security companies, private investigation and private prison, which are usually presented as the examples of privatization of criminal justice, only show 'pseudoprivatization' or 'partial privatization' other than 'complete privatization.' The concession and transfer of coercion is a grave problem upon which the destiny of the state depends. This because the state should not abandon its exclusive right over coercive power or transfer it to the market.
Even though private security seems to have been widespread and touched almost all part of criminal justice, it has not infiltrated into the essence of the state, the coercive power. The complete privatization of criminal justice requires the private security companies to substitute the organization and role of criminal justice. However, the state must not permit them to do so. The privatization of criminal justice cannot be, in this sense, properly understood without considering political ideology.
