각국 경찰의 집회시위 관리방식의 변천과정에 대한 비교 연구: 미국·영국·독일·일본 사례를 중심으로

Abstract

최근 우리나라는 폭력 과격불법 집회시위로 적지 않은 어려움을 겪고 있다. 따라서 본 연구는 미국, 영국, 독일, 일본 등 주요 선진국 경찰의 집회시위 관리방식의 변천과정을 비교 분석함으로써, 우리나라 경찰의 바람직한 집회시위 관리방식을 모색하는데 그 목적을 두고 있다. 미국, 영국, 독일, 일본 경찰의 집회시위 대응 및 관리방식은 지속적인 변화를 거듭해왔으며, 특히 1990년대 이후 새로운 추세를 보이고 있다. 새로운 변화로는 ① 강제적인 법집행의 완화, ② 협상과 타협의 중시, 그리고 ③ 대규모 정보 수집이라는 세 가지 측면을 들 수 있다. 또 이들 국가의 집회시위 관리체제에 영향을 주는 요인으로는 정치체제, 정치문화, 여론과 상호작용이 포함되며, 이러한 요인들이 복합적으로 작용해 그 나라의 독특한 집회시위 대응 및 관리방식을 이루고 있다. 경찰의 바람직한 집회시위 관리를 위해서는 첫째 집회시위를 관리하는 경찰이 조직과 훈련 그리고 다른 기관과의 협력을 강화해야 하며, 둘째 집회시위 발생이전에 집회시위 허용지역과 집회시위 금지지역에 대한 구체적이고 명확한 설정이 필요하고, 셋째 경찰과 집회시위 주도자들이 행동결과에 대해 다양한 각도에서 충분한 예상을 해야 하며, 넷째 집회시위 발생 지역의 이해 당사자들과 집회시위 주도자들과의 커뮤니케이션 활성화가 필요하고, 마지막으로 집회시위와 관련된 모든 당사자들 간 신뢰가 이뤄질 수 있도록 해야 한다.

The Comparative Study on the Historical Changesin the Protest and Its Control of the Police: Focusing on the Cases of the United States,the United Kingdom, Germany, and JapanLe, Chang MoIn recent years South Korea has suffered from illegal violent protests. The destructive effects of these illegal violent protests are really serious, including wounded persons, physical damage, and economic loss. The purpose of this study is to suggest the effective strategies for the police to control protests, based upon the comparative analysis of the protest policing in such advanced countries as the United States, the United Kingdom, Germany, and Japan. The protest policing style of these countries has changed and particularly showed a new trend since 1990s. The new trend includes ① under-enforcement of the law, ② the search to negotiate, and ③ large-scale collection of information. The infuencing factors for protest policing involve institutional characteristics, political culture, public opinion, and interaction between the police and protesters.
