미국 반독점 소위원회 “디지털 시장 경쟁 조사” 보고서의 주요 내용 및 시사점

Abstract

미국 하원 법사위원회는 반독점 소위원회의 주도 하에 미국 디지털 시장의 경쟁상황을 분석하고, 시장지배적 기업이 반경쟁적 행위를 하고 있는지 여부, 현재의 반독점법과 경쟁 당국의 반독점 집행수준이 디지털 시장의 문제 해결을 위해 적절한지의 여부를 조사하였다. 조사 결과 반독점 소위원회는 시장지배적 온라인 플랫폼들이 문지기 및 중개자로서의 역할을 활용하고, 킬러인수를 통해 시장지배력을 획득ㆍ유지ㆍ강화하고 있으며, 이로 인해 미국 경제의 혁신과 기업가 정신이 약화되고, 민주주의가 쇠퇴하고 있다고 결론내렸다. 반독점 소위원회는 이러한 문제점들을 해결하기 위한 여러 가지 방안들을 미국 의회에 권고하였다. 미국 하원은 동 보고서의 권고 내용을 토대로 플랫폼 관련 5개 법안을 발의하였다. 이에 따라 본 논문에서는 반독점 소위원회의 권고 사항을 상세히 살펴보고, 이에 대한 시사점을 도출해 본다.

Under the leadership of the anti-trust subcommittee, the U.S. House Judiciary Committee analyzed competition in the U.S. digital market, investigated whether market-dominant companies were engaged in anti-competitive behavior, and whether current anti-trust laws and competition authorities were appropriate to solve problems in the digital market. According to the survey, the anti-trust subcommittee concluded that market-dominant online platforms are using their roles as gatekeepers and intermediaries, gaining, maintaining, and strengthening market dominance through killer acquisitions, weakening the innovation and entrepreneurship of the U.S. economy and declining democracy. The anti-trust subcommittee recommended several measures to the U.S. Congress to address these problems. The U.S. House of Representatives proposed five platform-related bills based on the report’s recommendations. Accordingly, in this paper, the recommendations of the Subcommittee on Antitrust are examined in detail, and implications for this are derived.
