북한의 경찰법령과 경찰업무 처리에 관한 분석

Abstract

북한의 경찰법령과 경찰업무 처리절차에 대한 체계적인 분석은 매우 중요한 법적 연구과제이다. 이는 남북한 경찰법제 통합의 전제인 동시에 그 방향을 가늠하는 향도적 역할을 할 수 있기 때문이다. 전반적으로 볼 때 아직까지 북한의 경찰법령은 대한민국과 견주어 볼 때 상대적으로 소략한 편이며 치밀함을 갖추고 있지도 못하다. 단지 인민보안단속법상의 주민단속이나 형사소송법에 따른 형사사건 처리(특히 수사 및 예심 절차)에 있어서 북한 경찰의 임무와 역할이 비교적 상세하게 규정되어 있을 뿐이다. 남북한 경찰법제 통합 준비의 일환으로 북한의 경찰법령에 대한 추가적인 조사 및 문제점 분석 등 후속적인 연구가 앞으로도 계속 이루어져야 한다. 이를 기반으로 해서 남북한 경찰법제 통합의 제대로 된 밑그림을 지금부터 마련해야 할 것이다.

A systematic analysis of North Korean police-related laws and police Duties-performing Procedures is very important. It's because such a study could be a premise for the integration of South-North Korean legal systems on national police and also play a guiding role in setting up its direction. As a whole, North Korea's police regulations are not numerous and elaborate in comparison with those of South Korea. Cracking down of residents and managing criminal cases(especially under investigation and pretrial hearing procedures) are legally formulated or stipulated by People's Security Control Act and Criminal Procedure Code respectively. In this perspective, making Unified Korea's police regulations should be conducted on the basis of South Korean ones. Notwithstanding, subsquent studies concerning this issue are to be encouraged. We should prepare a good design to integrate South-North Korean police laws and regulations from now on.
