화상공증제도의 도입에 관한 검토

Abstract

새롭게 도입된 전자공증제도가 그다지 활성화되지 못하고 있다. 그 이유로 여러 가지를 들 수 있을 것이나, 그 가운데 하나는 공증인을 직접 대면하여야 한다는 요건과 관련하여 촉탁인이 반드시 공증인 사무소에 출석하여야 한다는 점에서 전자공증이 일반공증과 그다지 차이가 없다는 점이다. 즉, 공증의 모든 프로세스가 온라인상으로 사이버공간에서 완결될 것이라고 생각하는 이용자 측에서 본다면, 전자문서를 온라인으로 업로드 할 수 있도록 하면서도, 결국은 공증의 직접 대면성 때문에 공증인 사무소에 출석하여야 한다는 점에서 번잡하고 불편하다고 생각하기 때문일 것이다. 따라서 공증인과 촉탁인의 대면 요건과 방식을 완화하거나 변형하는 차원에서 영상의 실시간 쌍방향 전송기술을 이용한 화상공증제도의 도입을 검토하였다.

The electronic notarization system recently introduced in Korea is not being actively used for several reasons. One of the reasons is that a client must visit a notary office, which means that the requirement for a face-to-face meeting with a notary public applies both for electronic and non-electronic notarization. Considering users’ expectations that all processes of notarization will be completed online, they are likely to find it cumbersome and inconvenient to ultimately visit a notary office for a face-to-face meeting while they are allowed to upload electronic documents online. Under these circumstances, this study examines possible introduction of the video(remote) notarization system utilizing real-time bi-directional image transmission technology in a bid to relax or modify the requirement and method of a face-to-face meeting between a notary public and a client.
