Abstract

This paper aims to explain to the historical significance of a controversy on the essence of the law between Minobe Tatukichi and Yokota Kisaburo. This article approaches essence of the thought of the wartime period by analyzing it. Three points will be demonstrated throughout my analysis.(1)In the early 1930s, Minobe and Yokota debated about the essence of the law, but their opposition decided the stance of both opposition decided the stance of both for “the situation”; (2)In the wartime period, Paradoxically Minobe’s theory became a premise to bring about ”Greater East Asian Co-Prosperity Sphere” idea beyond his own intention;(3)Minobe's theory gave a theoretical foundation to the thought in the wartime. 본고에서는 미노베 다쓰키치(美濃部達吉)와 요코다 기사부로(横田喜三郎)의 논쟁을 명확히 해명하여 전시사상(戦時思想)의 본질에 접근하고자 한다. 본고의 분석을 통해 (1)1930년 전반에 걸쳐 미노베와 요코다는 법의 본질을 둘러싸고 논쟁을 벌였는데 이 대립이 “시국(時局)”에 대한 양자의 입장을 정하였다. (2)전시기(戦時期)에 있어서 미노베 학설이 본인의 의도를 넘어 전시기의 사상, ‘대동아공영권’ 사상을 만들어내는 전초가 되었다. 마지막으로 (3)미노베의 이론과 전시사상이 근접한 것이었다는 점을 명확히 하였다.
