- Abstract
- 본고에서는 행정법상 특허 개념이 주로 연혁에 초점을 맞추어 다루어진다. Otto Mayer의 특허 개념(Verleihung, Konzession)부터 시작해서, 그에게 영향을 미친 프랑스법의 특허 개념(concession), 우리에게 큰 영향을 미치고 있는 전통적인 독일법의 특허 개념(Konzession)을 순서대로 분석해서 서로 비교한 다음에, 이와 구별되어야 할 개념으로서 독일법의 공무수탁사인(Beliehene)과 특허 방식의 민관협력, 그중에서도 특히 공공서비스특허(Dienstleistungskonzession)를 검토한다. 이러한 비교법적 연구가 우리의 행정법이론을 이해하는 데 도움이 되었으면 한다.
