- Abstract
- 대상판결은 채권자가 채무자의 금전채권에 대하여 가처분결정을 받아 가처분결정이 제3채무자에게 송달되고 그 후 본안소송에서 승소하여 확정되었다면, 가처분결정의 송달 이후에 실시된 가압류 등의 보전처분 또는 그에 기한 강제집행은 가처분의 처분금지 효력에 반하는 범위 내에서는 가처분채권자에게 대항할 수 없다고 한다. 이는 채무자의 제3채무자에 대한 금전채권에 관하여 취소채권자의 가처분 효력이 발생한 이후에 수익자의 고유채권자가 가압류하더라도 취소채권자에게 대항할 수 없다고 밝힌 최초의 판결로 평가된다. 동일한 목적물에 대하여 가압류와 가처분이 경합하는 경우, 집행채권자의 법률상 지위가 양립할 수 있는 때에는 처분금지의 효력이 문제되지 않지만 양립할 수 없을 때에는 그렇지 않는다. 소유권이전등기청구권에 대한 가처분과 가압류결정은 금전채권의 보전처분과 달리 제3채무자가 채무자에게 소유권이전등기절차를 이행하는 것을 변제금지의 내용으로 하므로, 집행채권자의 법률상 지위가 양립할 수 있다. 반면에 골프회원권에 대한 가처분과 가압류결정은 누구에게 그 법률상 지위가 귀속되는지에 관한 것으로 양자의 권리가 양립할 수 없다. 따라서 대법원ﾠ2009.12.24.ﾠ선고ﾠ2008다10884ﾠ판결을 인용하여 사해행위 목적물에 대한 가처분의 처분금지 효력이 미치는 범위 내에서 가압류의 효력을 부정한 대상판결의 태도는 타당하다고 할 것이다.
