- Abstract
- 국제물품매매에서 매수인의 대표적인 대금지급방식 세 가지로, 화한신용장방식과 추심방식, 송금방식이 있고, 현재 그 중 송금방식이 가장 널리 사용되고 있다. 그리고 국제물품매매를 규율하는 대표적 국제규범은 CISG이다. 이에 본고는 매수인의 사후송금방식에 의한 대금지급의 문제를 논의한다. 먼저 사후송금방식의 개념을 살피고, 이어 CISG상 사후송금에 의한 대금지급의 이행 및 불이행의 문제를 고찰하면서 송금액, 송금시기, 변제충당의 문제를 검토한다. 다음으로 본고는 사후송금액에 영향을 주는 대표적인 상계제도를 고찰하면서 상계의 요건과 효과를 검토한다.
