- Abstract
- 국제물품매매에서 매매계약은 주계약이 되고 운송계약과 보험계약, 신용장은 종계약이 된다. 주계약인 매매계약은 내용의 면에서 종계약을 지배하므로, 종계약은 매매계약에 적합하여야 한다. 종계약이 매매계약에 반하는 것은 매매계약 위반이 되고, 당사자는 매매계약상 그 부적합에 대한 책임을 지게 된다. 이러한 배경에서 본고는 종계약들이 어떤 점에서 주계약인 매매계약에 적합하여야 하는지를 고찰한다. 먼저 매도인이 체결하는 운송계약과 운송서류의 적합성을 살피고, 다음으로 매수인이 대금지급을 위하여 제공하는 신용장의 적합성을 살피며, 끝으로 매도인이 체결하는 보험계약과 보험서류의 적합성을 살핀다.
