갈등해소를 위한 대화협의체 형성 동인에 관한 연구: 합의형성적 대화협의체를 통한 갈등해소 사례를 중심으로

Abstract

본 연구는 지난 20여 년간 우리나라에서 발생한 7개의 주요 갈등사례를 대상으로 대화협의체 형성 동인을 분석하여 봄으로써 대화협의체 구성에 드러난 문제점을 진단하고, 이를 통해 사회적 비용을 저감할 수 있는 사전적 갈등관리 전략을 제시하고자 하였다. 대화협의체의 구성은 합의형성을 위한 준비단계로서 이해관계자들을 협상테이블로 이끌어 내는 단계로 이해될 수 있다. 이를 위하여 다수의 학자들이 이미 제시한 대화협의체 형성에 영향을 미치는 이론적 요소들을 본 연구에 맞게 재구성하여 분석의 틀로 활용하였고, 갈등해소를 위한 합의형성단계 이전인 대화협의체를 촉발시키는 내적 요인들을 도출하고 분석하였다. 분석 결과, 7개의 사례에서는 최초의 갈등 발생 이후 평균 약 5년이 지나서야 대화가 시작되었고, 당사자 간 대화 협의의 구조도 자생적으로 형성되기 보다는 대통령, 국회(의원), 부처장관 및 고위급관료 등의 강력한 정치적 영향력 있는 제 3자의 압력으로 본격적인 대화가 시작되었다. 즉, 우리나라에서는 갈등의 사회적 비용이 높아져야 정치적 주목을 받게 되고 비로소 갈등관리가 시작되는 패턴을 도출할 수 있었다. 따라서 본 연구는 갈등의 사회적 증폭이 되기 전에 당사자간 대화가 시작될 수 있도록 근거규정을 만들 것을 제안한다. 대화 협의체의 구성방법과 절차에 관한 근거규정이 만들어지지 않고서는 계속해서 정치적인 영향력에 의지해 대화가 시작될 수밖에 없기 때문이다.

This study attempted to find factors for discussion-tables organized to resolve conflicts from seven public conflict cases occurred during the last 20 years. The goal of this paper is to find effective conflict management strategy to decrease social costs from public conflicts. A discussion-table is an arena of stakeholders involved in a public conflict to resolve it with discussion. A discussion-table is not automatically organized by stakeholders. Throughout conflict processes, someone may want to talk, but others may not. Sometimes, they even refuse to talk. This paper analyzed the seven cases which successfully formed a discussion-table and found that most of the cases organized the discussion-tables were formed by political influences of powerful politicians, by not stakeholders themselves after they had gone through hardship and pains. This patterns have been repeated and caused serious social costs. This paper suggested that we would need to develop institutional infrastructure for stakeholders themselves to organize a discussion-table to resolve their conflicts thru consensus building without involvement of the high levels of politicians and bureaucrats.
