의사결정과 결정오차에 관한 정약용의 사상 연구: 형사사건의 판단을 중심으로

Abstract

이 논문의 목적은 의사결정과 의사결정 오차에 관한 다산 정약용의 사상과 논의를 현대적 의미로 재해석하는 것이다. 이를 위해 목민심서(牧民心書)와 흠흠신서(欽欽新書)를 중심으로 목민관의 사법적 판단과 의사결정에 관한 정약용의 사상과 논의를 분석하고, 정약용이 의사결정 오차(decision errors)를 어떻게 이해하고 있는가를 살펴보았다. 분석결과 정약용은 현대의 의사결정 연구자들이 관심을 갖는 주제와 고민들에 대해 이미 상당히 체계적이고 분석적인 논의를 전개하였음을 알 수 있다. 첫째, 정약용은 인간이 지니는 제한된 의사결정 능력을 냉철하게 인식하고, 그 결과 목민관의 판단과 의사결정에도 오차가 개입될 수 있음을 지적하였다. 둘째, 정약용은 의사결정 오차를 거짓긍정과 거짓부정의 경우로 구분하고, 두 오차의 제거가 어려운 일이기는 하지만 이를 최소화하기 위한 노력을 전개할 것을 역설하였다. 또한 정약용은 두 오차간의 적정한 교환율에 대해서도 고민을 하였다. 마지막으로, 정약용은 의사결정 오차의 주요 유발요인으로 잘못된 정보에 대한 주목, 정보들 간의 허위상관의 문제, 의사결정과정에서의 주요 정보의 누락 등에 주목하였다.

The purpose of this study was to investigate Yakyong Jung's thoughts and insights about judgment and decision making and, further, reinterpret them from a modern perspective. For this, this study investigated Jung's ideas on criminal judgment and decision making represented in his well-known books, entitled "Mokminsimseo" and "Humhumsinseo." The results indicated that he already addressed and discussed many important issues covered in the current research on judgment and decision making. First, he recognized "bounded rationality" embedded in human judgment and, moreover, pointed out errors in governor's judgment and decision making. Second, he classified decision errors into false negatives and false positives and demanded efforts to minimize both errors. Third, he also attempted to find the appropriate trade-off between false positives and false negatives. Finally, he pointed out important judgmental heuristics that cause decision errors including selective attention to irrelevant information, spurious correlation between cues, and omission of important information.
